Extenuating circumstances

All extenuating circumstances processess are administered at School level. Further information on how to apply. You should follow the review process if you are dissatisfied with the outcome of a mitigating circumstances application.

What is the mitigating circumstances review process?

The mitigating circumstances review process is administered by OSCAR.

If you submitted an application to the Mitigating Circumstances Board and are dissatisfied with its decision you may request a review, but only under specific grounds:

  • that the decision not to grant mitigating circumstances was wholly inconsistent and/or unsupported by evidence presented and/or
  • that there was a material and/or procedural irregularity by the Mitigating Circumstances Board which has prejudiced the student's case
  • that additional evidence has come to light since the decision of the Mitigating Circumstances Board which could not reasonably have been expected to have been produced at the time of the consideration of the application.

What should you do if you wish to submit a request for a review?

You should submit, within 10 days of being informed of the decision of the Mitigating Circumstances Board, requesting a review of the decision made by the board preferably using the Mitigating Circumstances Review Form. Your form must be addressed and sent to OSCAR, and must cite which of the grounds for a review is relevant to your case. Further information on the review process is available at paragraph 19 of the Extenuating Circumstances Regulations (Taught Provision).
